Do MP3 free SW developers pay 1 Million USD?

I ran into a web site,
http://swpat.ffii.org/patents/effect.../index.en.html
Which has the following quote.

.....In order to develop free software for MP3,
one must pay an upfront payment of 1 million USD.
Otherwise money must be charged per copy,
thus barring the possibility of opensource development."

I thought if no money is charegd there is a nominal fee.
Can anyone confirm teh accuracy of this statemnt.

This site is pushing Vogg so this statement seems
suspect.

I know that Redhat removed MP3 support from Linux because of the licensing
costs, so it might be true.
