Unfortunately, they will probaby try that. Keep in mind that in the
early 1990s, the Supreme Court nearly banned VCRs (they voted 5-4 that
VCRs can be used in homes for legal and legit purposes). Well, today
they reversed their 1986 decision on sodomy with a 6-3 vote, so it is
possible that they can reverse their stance on the home copying issue.
If this does in fact pass, then the RIAA and the MPAA will probably
call for legislation either taxing the hell out of recorders (VCRs,
TiVos, DVD recorders, CD-Rs, CD-RWs, and audio cassette recorders) and
blank media (blank audio tapes, blank video tapes, blank CDs, and
blank DVDs) or an outright ban on the manufacture, sale, distribution,
or possession of recorders, blank media, and pirated
music/movies/software. Either way (tax or ban), eBay would probably
have to ban sales or auctions of recorders and blank media because
Congress would put either a "no unauthorized sales or recorders and
blank media" clause or a "the sin tax applies even to re-sales"
clause. Needless to say, if Congress banned recorders and blank media
(I couldn't see them rounding up troops to do raids unless they hired
some narcs), eBay would have to ban the sale and auction of that
stuff.
