Ive just lost a lot of personal files due to a viral attack.I pay good money
to blueyonder to protect me from this kind of threat yet Ive contacted them
and they arent exactly being helpful.Has anyone any experience of taking an
isp to court for damages? And what compensation can be expected.

You have no case. You were negligent. You should have taken backups.

And next you'll sue the Highways Agency because you had a crash on one of
their roads, banged your head because you werenot wearing a seatbelt. That
the sort of scenario you're talking about?

No, the negligence is on the part of blueyonder in letting this virus
through. Its their responsibility to protect their users.

I suggest you read their Ts and Cs. You'll find that you are NOT covered
100%. It's still up to you to take "reasonable" precautions which
include running your own AV program and taking regular backups.

No that's YOUR problem! And is the ISP responsible for what you may or
may not have loaded onto your machine from a floppy or a CD? NO! My ISP
has virus protection - I STILL USED AN AV PROGRAM myself when using Windows.

FOR FUCK'S SAKE GET AN AV APP!

Anyway you've stuffed yourself so ha ha ha ha!

<Aside> and people wonder why Blueyonder users have this THICK
reputation on the net? Look no further!

*You* are responsible for what gets on to your system, not your ISP.
If you get a virus on your system it is because you have not taken
enough precautions to protect yourself.

And you are an expert in this I take it?
Can somebody with some experience with this situation respond, I am not
interested in being lectured to.

Go to any expert you like, they will all say "get an AV program and run
it". That's not being lectured to, that is a) COMMON SENSE and b)
accepted WORLD-WIDE security practice.

Now, accept that you have fucked up big time and LEARN from the experience.

Nope, BlueYonder only act as a carrier. You failed to take precautions. YOUR
FAULT.

No ISP in the world can answer for stupidity.

I work for a ISP, and no, you are not going to succed in suing the ISP. YOU
ARE THICK. STUPID. DUMBASS.

ISP's provide Virus cover, normally only as a optional extra. Did you
subscribe to that? No. Stupid. Even if you had, still run your own. The ISP
viral filter only protects against email virus, what about Blaster etc?
YOUR RESPONSABILITY.

If my electricity company sent a surge dowh yhe line and destroyed my
equipment, I would expect compensation.
This is just the same.

And if there was likelihood of that, fit a surge protector. Who would
you sue for a lightening strike, God?

Don't make yourself out to be more stupid than you already have.
