Overcharge on Termination?
Posted by GeoffO on November 26th, 2007

Hi,

After several good years with Madasafish (previously Totalise) I'm upgrading
to ADSL2 with Be. On 20th November I gave the required 28 days notice to
Madasafish and got my MAC number by email that day. Brilliant !

My problem is that 2 days later Madasafish sent my usual monthly Invoice for
the full calendar month of December and not up to 18th December as I was
expecting. I queried this with them and was emailed the following::

"Please be advised if you are liable for the full payment as we pay BT a
circuit fee in advance for the entire month even though you will not be
using the service. Therefore the full invoice is owed to us."

Ignoring their bad grammar, what's their contract with BT got to do with my
contract with them?? There's certainly no mention of this nonsense in their
T's & C's as far as I can see.

It's not a lot of dosh but where exactly do I stand on this ? Any advice
welcome...

Thnx

Geoff

You're quite right. Your contract is with Madasafish. Madasafish's
contract with BT is no concern of yours.

If there's nothing in their T&C or tariff (which is presumably covered
by the T&C, it's tough luck for them.

Requesting a MAC is not notice of cancellation. If you do not use the
MAC, the circuit will remain with Madasafish and they will continue to
incur a cost to provide this. If you do migrate within the notice
period, I am sure they will refund the "overpayment" over the end of the
notice period.

Have you actually thought of asking them? I thought their CS/support was
supposed to be highly regarded.
